Terms of Service
Please read these Terms of Service ("Terms") carefully before using the Airside application and website (collectively, the "Service") operated by Birge & Fuller, LLC ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into these Terms.
2. Description of Service
Airside is a flight-tracking application that aggregates real-time and scheduled flight data from third-party aviation data providers, overlays route-specific turbulence forecasts, and delivers push notifications for flight events. The Service is intended for personal, informational use only.
Flight information displayed by Airside — including schedules, delays, gate assignments, and positions — is sourced from third-party providers and may be incomplete, delayed, or inaccurate. Do not rely on Airside for safety-critical decisions. Always verify flight status directly with the airline or airport.
3. Account Registration
Accessing certain features requires signing in with a Google account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at support@airsideapp.com.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
- Attempt to gain unauthorized access to any part of the Service or its underlying systems;
- Use automated means (scrapers, bots, crawlers) to access or collect data from the Service;
- Interfere with or disrupt the integrity or performance of the Service;
- Reverse-engineer, decompile, or disassemble any portion of the Service;
- Resell, sublicense, or redistribute the Service or its data without our express written permission.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of Birge & Fuller, LLC and its licensors. The Airside name, logo, and related marks are trademarks of Birge & Fuller, LLC. You may not use these marks without our prior written consent.
Aviation data displayed in the Service is sourced from third-party providers and is subject to their respective terms and intellectual property rights.
6. Third-Party Services and Links
The Service integrates with third-party flight-data and aviation-weather providers. Your use of the Service is also subject to the terms and privacy policies of these providers. We are not responsible for the content, accuracy, or practices of third-party services.
7. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. FLIGHT DATA AND FORECASTS ARE PROVIDED FOR INFORMATIONAL PURPOSES ONLY AND MAY BE INACCURATE OR DELAYED.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BIRGE & FULLER, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOST DATA, OR PERSONAL INJURY — ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $10 USD.
9. Indemnification
You agree to defend, indemnify, and hold harmless Birge & Fuller, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service or your violation of these Terms.
10. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination shall survive, including Sections 5, 7, 8, 9, and 11.
11. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered in King County, Washington, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm. You waive any right to a jury trial or to participate in a class action.
12. Changes to These Terms
We may modify these Terms at any time. When we do, we will revise the effective date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If a change is material, we will make reasonable efforts to notify you (for example, by email or an in-app notice).
